Terms and Conditions
The following policies define the terms and conditions that govern both the way Tools-n-Gizmos
does business and your rights and responsibilities when dealing with Tools-n-Gizmos.
Quality
1. We always state the true condition of the item - to the best of our ability.
2. Unless otherwise stated all pictures are of the actual part you will receive.
3. We rate condition as follows: (also see special rating considerations for collets below)
 NIB-FF = New in Box - Factory Fresh
 These items are not surplus parts.
I bought them from the manufacturer for resale via. Tools-n-Gizmos.com, or
they can be purchased from Tools-n-Gizmos and shipped directly from the factory to you.
They are unopened and carry the full warranty of the manufacturer.
(e.g. Universal Engineering Warranty)
NIB = New in Box
New unused surplus items that are generally still in the original factory package.
If they had a protective coating when they left the factory then it is still mostly intact.
They however, may have been opened, handled, re-wrapped, dog-ear box, etc.
NOS = New Old Stock
These items are unused. But are generally out of the original packaging
They may have very minor surface blemishes (e.g. scratches) caused by handling
or improper storage. They are functionally equivalent to a brand new item.
EX = Excellent
These items are used. But are in excellent cosmetic and functional condition.
They may have some cosmetic imperfections (e.g. scratches) from light use.
But all working surfaces (e.g. tapers) are functionally as good as new.
VG = Very Good
These items are used. But are in Very Good cosmetic and functional condition.
They have some scratches/dings/staining caused by normal use.
But are clean/smooth/tight and should perform very well.
GF = Good Functional
These items are used. But are in Good Functional condition. Cosmetically
they may look a little rough (with scratches/dings/staining) but they are clean,.
have no rust (may have slight pitting from former rust) and should perform well.
PR = Poor
These items are in poor condition. The item description will give you details
on why the specific item is considered in poor condition. Generally the item
is either in bad cosmetic condition (major scratches/dings/rust pits, etc),
in poor functional condition (sticky operation, missing tang on MT taper, etc) or both.
UNK = Unknown
The functional condition of these items is not known.
Unless otherwise stated items classed as UNK are purchased as is without
any warranty as to their functionality. This rating most often will apply to used
items that we have not tested. (e.g. used electrical and electronic items, Hyd values, etc.)
NH = Needs Help
These items are in need of some work. See the item description for details
on the specific issue with that item. The cosmetic and functional conditions
are not defined by this rating. The item could be NOS with a missing part,
VG except for surface rust, or any combination of cosmetic and functional condition.
But we deem that the item could be returned to at least Good Functional condition
with some work.
POC = Piece of Crap
Do we really need to further define this rating??

Special Rating considerations:
In addition to the above general condition rating criteria, the rating of some items
will be reduced (never increased) based on the following considerations:
1. Steel Collets (especially Double Taper collets) are susceptible to collapse due to misuse
or mishandling. Every collet I sell has been tested to insure that it will accept the intended
size tool. Small collets (5/8" ID or less) are pin gauge verified and larger collets are tested
using a tool shank or actually measured if the appropriate size tool is not available.
If a collet is slightly undersize (snug fit, but tool can easily be inserted by hand),
and is otherwise in excellent condition, I give it an Excellent condition code.
If a collet is undersize (tight fit that requires force to insert tool, but can be inserted by hand)
it is given a Very Good condition code, even if the collet is otherwise in excellent condition.
If a collet is undersize (very tight fit, hard to insert tool by hand) it is given a Good
Functional condition code.
If the collet is undersize to the point of requiring mechanical assistance to insert tool,
or worse, it is given a Poor (or worse) condition code and the detailed description of
that collet will define how bad the collapse is.
2. Rubber-Flex Collets (especially large lathe collets) are susceptible to wear at the point
where the lip of the chuck mouth interfaces with the collet metal inserts (about 1/4" down from
the top of the insert). I use the finger nail test to determine the extent of wear on the insert.
If I can feel the wear point then I downgrade the collet to Very Good, (if it is otherwise in
Excellent condition).
If the wear point has a very noticeable dip then it is considered Good Functional.
If there is a deep groove or it has a sharp lip then the collet is rated Poor (or worse)
and the detailed description of the specific collet will give details.
3. Rubber-Flex Collets can get hard with age and from contact with various chemicals.
The harder the rubber gets the harder it is to close the collet down to it's lower holding range.
Hard rubber can also crack and or separate from the metal inserts when compressed.
When I close a J9xx collet to the bottom of its range in my Jacobs spindle nose lathe chuck:
If it closes easy with only one hand then I won't downgrade its rating for hardness.
If it's hard to close with only one hand then I rate it Very Good or less.
If it takes 2 hands to close then its rated Good Functional, Poor or Worse
based on how hard it was to close and if any cracking or separation occurs.

Return Policy
1. Please Contact us before returning any product.
2. The product must be returned in the same condition as shipped for full credit.
3. Send all items insured for the replacement amount of the item(s) being sent.
Tools-n-Gizmos is not responsible for items lost in shipping.

A. Overview
This Privacy Policy describes the information we collect about you and how we use that information. Tools-n-Gizmos takes the privacy of your personal information very seriously and will use your information only in accordance with the terms of this Privacy Policy. We will not sell or rent your personally identifiable information or a list of our customers to third parties. However, as described in more detail in Part C below, there are limited circumstances in which some of your information will be shared with third parties, under strict restrictions, so it is important for you to review this Privacy Policy.
This Privacy Policy will take effect on Jan 1, 2004.
Please note that your personal information will be stored and processed on our computers in the United States. The laws on holding personal data in the United States may be less stringent than the laws of your country, but Tools-n-Gizmos will hold and transmit your personal information in a safe, confidential and secure environment.
Changes to this policy
This policy may be revised at any time. If we are going to use or disclose your personally identifiable information in a manner materially different from that stated at the time we collected the information, you will have a choice as to whether or not we use or disclose your information in this new manner. Any material changes will be effective only after we provide you by e-mail with at least 30 days' notice of the amended Privacy Policy.
We will post the amended Privacy Policy prominently on our web site so that you can always review what information we gather, how we might use that information, and whether we will disclose it to anyone.
The Tools-n-Gizmos web site includes links to third party web sites. These sites are governed by their own privacy statements, and Tools-n-Gizmos is not responsible for their operations, including but not limited to their information practices. Users submitting information to or through these third party web sites should review the privacy statement of these sites before providing them with personally identifiable information.
Children are not eligible to use our services and we ask that minors (under the age of 18) do not submit any personal information to us or use our services.

B. Information We Collect
Required Information
To purchase products from us, you must provide your name, address, phone number, and e-mail address. This information is needed for us to ship the product and to contact you in the case of problems or questions about your order.
Transaction Information
We do not have access to your credit card, billing address or other financial information. When you use a credit card to purchase Tools-n-Gizmos products you are dealing with PayPal, who process your credit card for us, via their high security system. They transfer the funds to Tools-n-Gizmos PayPal account and notify us that payment was made. They do not provide us with any of your financial information. The information you provide on our checkout page (items ordered, name, shipping address, phone number, and e-mail address) is retained by our website software so we can process your order.
Web Site Traffic Information
Because of the way World Wide Web communication standards work, when you arrive at or leave the Tools-n-Gizmos web site, we automatically receive the Web address of the site that you came from or are going to. We do collect information on which pages of our web site you visit while you are on the Tools-n-Gizmos site, the type of browser you use and the times you access our web site. We use this information only to better understand our customers' preferences and to manage the load on our server to thus improve our service and your experience with Tools-n-Gizmos. We do not track the web sites that you visit before or after you leave the Tools-n-Gizmos site.
Our Use of "Cookies"
"Cookies" are small files of data that reside on your computer and allow a web site to recognize you if you return to the site using the same computer and browser. The only cookies we currently use are limited life "cart_id cookies" that allow the site software to remember your cart contents between sessions. The Tools-n-Gizmos site software will "remember" cart contents for up to 3 days. So if you add items to your shopping cart, leave the site and return within 3 days, the unpurchased items in your cart will still be in your cart. This is the only use for the Tools-n-Gizmos cookie. We do not collect, retain or link this information to any other information about you unless you complete a purchase. When you complete a purchase the cart_id becomes a part of the record of purchase and the cart is emptied. After a purchase (or if your cookie has timed out), the next time you visit the site a new random cart_id is assigned and the process starts over with a new cookie. If you have your system set to not allow cookies then your computer will be viewed as a new customer every time you enter the on-line store and each time you will start with a new (empty) shopping cart.
Customer Service Correspondence
If you send us correspondence, including e-mails and faxes, we retain such information in the records of your account. We will also retain customer service correspondence and other correspondence from Tools-n-Gizmos to you. We retain these records in order to measure and improve our customer service. We may, over time, delete these records if permitted by law.
Questionnaires, Surveys and Profile Data
From time to time, we may offer optional questionnaires and surveys to our customers for such purposes as collecting demographic information or assessing users' interests and needs. The use of the information collected will be explained in detail on the survey or questionnaire. If we collect personally identifiable information from our users in these questionnaires and surveys, the users will be given notice of how the information will be used prior to their participation in the survey or questionnaire.

C. Our Use and Disclosure of Information
Internal Uses
We collect, store and process your personal information on computers located in the United States. We use the information we collect about you in order 1) to provide our services and process your transactions, 2) to provide customer service, 3) to improve our products and services.
We give access to your individually identifiable information only to those employees who require it to fulfill your customer service requests.
Disclosure to Third Parties
Tools-n-Gizmos will not sell or rent any of your personally identifiable information to third parties. Tools-n-Gizmos will not share any of your personally identifiable information with third parties, except in the limited circumstances described below, or with your express permission. These third parties are limited by law or by contract from using the information for secondary purposes beyond the purposes for which the information is shared.
Tools-n-Gizmos does currently use drop shipping of some items (those tagged with NIB-FF condition code). So, part of your order may be shipped from a supplier directly to you. In this case, they would need your name and shipping address. These companies are subject to confidentiality agreements with us and other legal restrictions that prohibit using the information except to ship the specified products , unless you have affirmatively agreed or given your prior permission for other uses.
We may disclose information, that we in good faith believe is appropriate, to cooperate in investigations of fraud or other illegal activity. We will disclose information in response to a subpoena, warrant, court order, levy attachment, order of a court-appointed receiver or other comparable legal process, including subpoenas issued in a civil action.
We share aggregated statistical data with our business partners or for public relations. For example, we may disclose that a specific percentage of our users live in California. However, this aggregated information is not tied to personally identifiable information.
As with any other business, it is possible that Tools-n-Gizmos in the future could merge with or be acquired by another company. If such an acquisition occurs, the successor company would have access to the information maintained by Tools-n-Gizmos, but would continue to be bound by this Privacy Policy unless and until it is amended as described in Section A above.
Our Contacts with Tools-n-Gizmos Customers
We communicate with users via e-mail or phone to provide requested services or resolve customer complaints. We use your e-mail address to send information about important changes to our products and services, and to send notices and other disclosures required by law. Generally, users cannot opt out of these communications, but they will be primarily informational in nature rather than promotional.
In connection with independent audits of our financial statements and operations, the auditors may seek to contact a sample of our customers to confirm that our records are accurate. However, these auditors cannot use personally identifiable information for any secondary purposes.
Internet Address Information
We use IP addresses, browser types and access times to analyze trends, administer the site, improve site performance and gather broad demographic information for aggregate use.

Warranty
A. Overview
Tools-n-Gizmos provides the best information about its products and services that we can and will do everything we can to make you a happy customer. However, the products we sell are surplus items and we do not know the history of any specific item and cannot make legal representation as to its condition or suitability for use. The best we can do is state our opinion about the condition of the item, provide pictures of the product and share information we believe to be correct. If any item you purchase from Tools-n-Gizmos is not up to your expectations, please contact us so we can make it right (if possible).
B. Disclaimer of Warranties
All information, content, materials, products (including software) and services included on this site or otherwise made available by Tools-n-Gizmos are provided on a "as is" and "as available" basis. A. Limitation of Liability
To the extent permitted by law, in no event, shall Tools-n-Gizmos, it's agents, licensors, suppliers, or any third parties mentioned at Tools-n-Gizmos.com be liable for any incidental, indirect, exemplary, punitive, and consequential damages, lost profits, lost goodwill or reputation, damages resulting from lost data or business interruption resulting from the use of or inability to use our products, sites and services, content or information whether based on warranty, contract, tort, delict, or any other legal theory, and whether or not Tools-n-Gizmos is advised of the possibility of such damages, without limiting the foregoing, to the extent permitted by applicable law. You agree that in no event shall Tools-n-Gizmos' total liability for any damages (direct or otherwise) or loss regardless of the form of action or claim, whether in contract, tort or otherwise, exceed the greater of (a) the sell price and total fees you paid to us during any specified transaction giving rise to the liability, and (b) $100. To the extent permitted by law, the remedies stated for you in these terms and conditions are exclusive and are limited to those expressly provided for in these terms and conditions.
B. Use by Children
If you are under 18, you may use Tools-n-Gizmos.com only with involvement of a parent or guardian. You must be at least 18 to make a purchase from Tools-n-Gizmos.com
